⚖ Terms & Conditions — Legal Agreement

This document constitutes a legally binding agreement between you and Golden Safety. By accessing our website, purchasing products, enrolling in training, or engaging our consulting services, you agree to be bound by these Terms and Conditions in their entirety. If you do not agree, do not use our services.

1. Company Information

Golden Safety is a safety training, consulting, and products company operating in Canada. We provide occupational health and safety (OHS) training courses, safety consulting services, health & safety program development, safety forms, and personal protective equipment (PPE) and safety gear sales to clients across Canada and internationally.

2. Acceptance of Terms

By accessing or using any portion of golden-safety.ca, enrolling in any training course, purchasing any product, or engaging Golden Safety for consulting services, you confirm that you are at least 18 years of age, have the legal capacity to enter into a binding agreement, have the authority to bind any organization you represent, and have read, understood, and agree to these Terms and Conditions in full.

These Terms apply to all visitors, users, clients, students, and others who access or use our services. Use of our services after any posted changes constitutes acceptance of the revised terms.

3. Services Offered

Online Safety Training Courses

Including WHMIS 2018, H2S Alive, Fall Protection, Confined Space Entry, Ground Disturbance, and other occupational health and safety courses. Completion certificates are issued upon passing required assessments.

Safety Consulting Services

Including safety audits, H&S program development, COR/SECOR preparation, Job Hazard Analysis (JHA), risk assessments, incident investigation support, JHSC support, and field safety advisory services.

Health & Safety Program Development

Creation and review of company safety manuals, policies, procedures, site-specific safety plans, emergency response plans, and related H&S documentation.

Products & Equipment Sales

Personal protective equipment (PPE), safety gear, safety forms, reference books, and other workplace safety products sold through our online store.

4. Liability Disclaimer

CRITICAL NOTICE: The following limitations of liability are a fundamental part of the basis of the bargain between you and Golden Safety. Golden Safety would not provide services without these limitations.

General Limitation of Liability

To the maximum extent permitted by applicable Canadian law, Golden Safety, its owners, officers, employees, contractors, agents, and affiliates shall NOT be liable for any direct, indirect, incidental, special, consequential, punitive, or exemplary damages arising out of or in connection with your use of our services, products, training, or information, even if Golden Safety has been advised of the possibility of such damages.

Training & Certification Disclaimer

Completion of any Golden Safety training course or receipt of a certificate does not guarantee compliance with all applicable OHS legislation in your specific jurisdiction, nor does it guarantee workplace safety. Training certificates represent the successful completion of generic training only. Employers remain solely responsible for providing workplace-specific training and ensuring full regulatory compliance.

Consulting Services Disclaimer

Any advice, recommendations, documents, programs, or plans provided by Golden Safety are for informational and guidance purposes only. Golden Safety is not a law firm and does not provide legal advice. All recommendations should be reviewed by qualified legal counsel before implementation. Golden Safety shall not be liable for any regulatory penalties, fines, workplace injuries, incidents, or damages arising from the implementation or non-implementation of any consulting advice.

Workplace Safety Responsibility

Golden Safety’s services do not transfer, substitute, or reduce the legal obligations of employers, supervisors, or workers under the Alberta Occupational Health and Safety Act, the Canada Labour Code, the Hazardous Products Act, or any other applicable legislation. Employers remain solely and fully responsible for the health and safety of their workers at all times.

International Disclaimer

Golden Safety services are designed based on Canadian OHS legislation and standards. While our services may be purchased by clients worldwide, Golden Safety makes no representation that any service, certificate, training program, or product meets the specific legal or regulatory requirements of any jurisdiction outside Canada. International clients acknowledge full responsibility for ensuring compliance with all applicable laws in their own country.

Maximum Aggregate Liability

In the event Golden Safety is found liable for any claim, its total aggregate liability shall not exceed the total amount paid by you to Golden Safety for the specific service or product giving rise to the claim in the twelve (12) months preceding the event.

No Guarantee of Results

Golden Safety makes no representations or warranties that use of our services will result in passing government audits, achieving COR/SECOR certification, passing any regulatory inspection, obtaining any specific contract or tender, or achieving any specific safety performance outcome.

Force Majeure

Golden Safety shall not be liable for any failure or delay in performance resulting from causes beyond its reasonable control, including acts of God, pandemic, government action, natural disaster, power failure, internet outage, or any other event outside Golden Safety’s reasonable control.

5. Training & Certification Terms

Certificate Validity

Training certificates issued by Golden Safety are valid for the period stated on the certificate (typically 3 years). It is the responsibility of the certificate holder and their employer to track renewal dates. Golden Safety is not responsible for expired certificates or any consequences arising from certificate expiry.

Generic vs. Workplace-Specific Training

All Golden Safety online courses provide generic safety training. Generic training must be supplemented by workplace-specific training provided by the employer as required by the Alberta OHS Act, Canada Labour Code, and all applicable provincial/territorial OHS legislation. Golden Safety certificates do not satisfy workplace-specific training requirements.

Assessment Integrity

By enrolling in any Golden Safety course, you agree to complete all assessments honestly and without assistance from unauthorized persons or sources. Fraudulent completion of assessments may result in immediate certificate revocation without refund.

Regulatory Acceptance — Canada & International

Golden Safety makes no guarantee that certificates or training materials will be accepted by any specific employer, regulatory body, government agency, WorkSafe board, or insurance provider in Canada or internationally. International clients are solely responsible for verifying the acceptability of our training with their applicable authority before enrollment.

7. Consulting Services Terms

Scope of Work

All consulting engagements shall be governed by a written scope of work, proposal, or service agreement signed by both parties. Work performed outside the agreed scope is subject to additional fees.

Client Responsibilities

Clients are responsible for: providing accurate and complete information; granting reasonable access to personnel, documents, and worksites; implementing recommendations at their own discretion and risk; and ensuring that any safety programs or documents developed by Golden Safety are reviewed by their own management and legal counsel before implementation.

Confidentiality

Golden Safety agrees to maintain the confidentiality of all client-specific information provided during consulting engagements. Clients agree to maintain the confidentiality of all proprietary methods, templates, and materials provided by Golden Safety.

8. Products & Sales Terms

Product Information

Golden Safety makes reasonable efforts to ensure product descriptions, specifications, and images are accurate. However, we do not warrant that product descriptions are error-free, complete, or current. Product images are for illustrative purposes only.

PPE Responsibility

Personal protective equipment (PPE) sold by Golden Safety must be selected, used, maintained, and inspected in accordance with manufacturer instructions, applicable CSA/ANSI standards, and workplace-specific requirements. Golden Safety is not liable for injuries resulting from improper selection, use, maintenance, or modification of PPE.

Availability & International Shipping

All products are subject to availability. International clients are solely responsible for any customs duties, import taxes, and regulatory compliance related to the importation of PPE or safety equipment in their country. Golden Safety is not liable for delays, seizures, or additional costs incurred at customs.

9. Intellectual Property

All content on the Golden Safety website and in Golden Safety training materials — including text, graphics, logos, images, course content, safety forms, templates, programs, and manuals — is the exclusive intellectual property of Golden Safety and is protected under the Copyright Act (R.S.C., 1985, c. C-42) of Canada.

10. Privacy & Data Protection

Collection & Use of Personal Information

Golden Safety collects personal information including name, email address, company name, and payment information for the purposes of providing services, issuing certificates, processing payments, and communicating with clients. Personal information is collected in accordance with the Alberta Personal Information Protection Act (PIPA) and applicable Canadian privacy legislation.

Training Records

Golden Safety retains training completion records including names, scores, and certificate details for a minimum of 3 years following course completion. These records may be provided to the certificate holder upon request.

Data Security

Golden Safety takes reasonable measures to protect personal information from unauthorized access, use, or disclosure. However, no internet transmission or electronic storage is 100% secure. Golden Safety cannot guarantee absolute security of personal information transmitted to or through our website.

International Privacy — GDPR & Global Compliance

For clients in the EU/EEA, Golden Safety acknowledges the applicability of the General Data Protection Regulation (GDPR). For US clients, we acknowledge applicable state privacy laws including the CCPA where applicable. All clients have the right to request access to, correction of, or deletion of their personal information by contacting goldensafetyab@gmail.com. Golden Safety does not sell personal information to third parties under any circumstances.

11. Payment Terms — CAD Only

Official Currency

All prices, fees, invoices, and transactions with Golden Safety are exclusively in Canadian dollars (CAD). Golden Safety does not transact in US dollars (USD), Euros (EUR), British pounds (GBP), or any other currency. The Canadian dollar amount stated at the time of purchase is the amount due.

Exchange Rates & Conversion

International clients are responsible for all currency conversion costs and exchange rate fluctuations. The final amount charged to your payment method in your local currency is determined by your bank or payment processor — Golden Safety has no control over exchange rates and is not responsible for any differences.

Taxes & Government Fees

Canadian clients: Applicable federal and provincial taxes (GST/HST/PST) will be added to all transactions as required by Canadian law. International clients: Golden Safety does not collect VAT, sales tax, or any other tax on behalf of foreign governments. International clients are solely responsible for declaring purchases and remitting any applicable taxes in their own country.

Payment Due Dates

Withholding of Deliverables

Golden Safety reserves the right to withhold certificates, deliverables, safety programs, and any other work product until payment is received in full in Canadian dollars.

Chargebacks & Disputes

If you have a billing concern, please contact us at goldensafetyab@gmail.com before initiating any chargeback. Chargebacks initiated without prior written notice to Golden Safety may result in immediate account suspension, revocation of certificates, and referral to a collections agency.

International Customs & Import Fees

International clients ordering physical products are solely responsible for all customs duties, import taxes, brokerage fees, and any other government-imposed charges applicable upon entry into their country. Golden Safety is not responsible for delays, seizures, or additional costs incurred at customs.

12. Refund Policy

Online Courses

Refunds for online courses are available within 7 days of purchase, provided the course has not been started (0% progress). Once a course has been accessed or started, no refund is available. Certificates that have already been issued are non-refundable under any circumstances.

Physical Products & PPE

Physical products may be returned within 30 days of receipt in original, unused, unopened condition with original packaging. PPE that has been used, worn, or removed from packaging cannot be returned for health and safety reasons. Return shipping costs are the responsibility of the customer unless the product was defective or incorrectly shipped.

Consulting Services & Documents

Safety programs, manuals, forms, and other custom-developed documents are non-refundable once delivered. For ongoing consulting retainers, cancellation requires 14 days written notice. Work completed prior to cancellation will be invoiced and is payable in full.

Downloadable Forms & Templates

All downloadable digital products are non-refundable once downloaded or accessed. Please review product descriptions carefully before purchase.

13. Governing Law & Jurisdiction

Canadian Law Governs

These Terms and Conditions are governed by and construed in accordance with the laws of the Province of Alberta and the applicable federal laws of Canada. Any dispute, claim, or controversy arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Alberta, Canada.

Dispute Resolution

Before initiating any legal proceedings, parties agree to attempt to resolve disputes through good-faith negotiation. If negotiation fails, parties agree to attempt mediation before pursuing litigation. The costs of mediation shall be shared equally between the parties.

International Users

Golden Safety operates from Canada and provides services to clients worldwide. Users accessing our website or services from outside Canada are responsible for compliance with their applicable local, national, and international laws and regulations.

14. Indemnification

You agree to indemnify, defend, and hold harmless Golden Safety and its owners, officers, employees, contractors, agents, licensors, and service providers from and against any and all claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable legal fees) arising out of or relating to:

Golden Safety reserves the right to modify, update, or replace these Terms and Conditions at any time at our sole discretion. We will post the revised Terms on this page with an updated effective date. Your continued use of our website or services after any changes constitutes your acceptance of the revised Terms. It is your responsibility to review these Terms periodically.

Permitted Use

Safety forms, templates, and other digital materials purchased from Golden Safety are provided under a limited, non-exclusive, non-transferable license for internal use within the purchasing organization only. This license does not permit resale, sublicensing, or redistribution.

Reporting Copyright Infringement

If you become aware of unauthorized use of Golden Safety’s copyrighted materials, please contact us immediately at goldensafetyab@gmail.com. Golden Safety takes copyright violations seriously and will take appropriate legal action.

⚖ Unauthorized reproduction, distribution, or use of Golden Safety’s intellectual property may result in civil and/or criminal liability under the Copyright Act of Canada and applicable international copyright law.

These Terms and Conditions constitute the entire agreement between you and Golden Safety with respect to the subject matter herein and supersede all prior agreements, representations, warranties, and understandings. If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
